GENERAL TERMS AND CONDITIONS OF SALE
Conditions of Sale: Everyone must register for a bidder's number. Buyer must be of legal
capacity to enter into this agreement. To register, a prospective bidder must provide name,
residence address, phone number, and a valid driver's license. By registering, a
prospective bidder is acknowledging any and all bidder information is accurate and
complete and that he or she has read and agrees to be bound by the Terms and Conditions
of Sale. Auctions United reserves the right to deny usage and access of services and website
at any time without notice or liability to any persons or third parties. Auctions United, Inc.
Reserves the right to suspend the right to suspend bidding privileges for any reason or no
reason. At times, during the registration process, bidders on personal property may be
asked to provide credit card information. During the registration process, credit cards
may be charged $1.00 (one dollar) in order to authorize their credit card upon registering
for the auction of personal property.
We are selling any and all property without warranties as to the condition and//or the
fitness of the property for a particular use. Buyers are solely responsible for examining
and judging the property for their own protection. Otherwise known as "As is, Where Is"
and "In its Present Condition". The Seller will not be responsible for any clean-up after
the auction or before the closing. Any items of personal property or trash left on the
property and remaining after the closing of the real estate will belong to the new owner of
the real estate. No statement, either oral or written, on this site, at the auction, or elsewhere
shall be deemed as any warranty, representation, or assumption of responsibility. Buyers
are urged to contact Auctions United, Inc. For detailed information on any lot.
Payment: Once the auction is complete, you will receive a phone call (in the case of real
estate) or email (personal property) with payment instructions. For personal property, your
card on file will be charged for your purchase. Auctions United, Inc. Must receive the full
balance of payment before the winning bidder may take possession of any personal
property being sold. If payment for winning personal property bids is not received within
24 hours after the final payment date, bidder authorizes Auctions United, Inc. To charge
liquidated damages to the credit card on file.
Closing Costs-Real Estate: Seller will pay for the deed preparation. Buyer of the Reas
Estate will be responsible for any title examination, attorney's loan closing fee, title
insurance, recording fees and any other fees required by a lender plus a $250.00 closing
attorney's fee per closing.
Buyer's Premium: Real Estate-A Ten Percent (10%) buyer's premium will be added to the
final bid to establish the final Sale Contract Price on real estate.
Personal Property-A fifteen percent (15%) buyers premium will be added to the final bid on
any personal property.
Personal Property Pickup: Pickup will be by appointment. Winning bidders will be
contacted to set up an appointment. No goods shall be removed until buyer's invoice has
been paid in full. No shipping is available. Bidder shall be responsible for the safe and
proper removal of any goods purchased. Auctions United, Inc. Shall have no responsibility
for any missing or lost items that can be removed by hand.
Taxes-Real Estate: All property taxes will be prorated to the date of closing for the Buyers
and Sellers.
Additional Terms-Real Estate: 10% Buyer's Premium down at close of auction with
balance due within thirty (30) days after final Seller approval. The 10% will be considered
earnest money. In the event Buyer fails to close for any reason, the earnest money shall be
retained by Seller.
Escrow-Real Estate: All funds collected at close of auction on Real Estate will be made
payable to the named closing attorney for each specific auction.
Closing-Real Estate: Closing will occur within thirty (30) days after final Seller approval.
Possession-Real Estate: Granted at closing.
Buyer's Note: Individual purchases are to be considered as singular transactions not
contingent upon the sale of other properties or tracts. Auctions United, Inc. Reserves the
right to offer the property in any way it sees fit in order for the property to bring th most
money for the Seller. Seller and Auctions United, Inc. Reserve the right to amend any
terms and conditions of the auction by announcing such changes prior to or during the
auction. All information published, announced, or contained herein was derived form
sources believed to be correct; however, such information is not guaranteed by Seller or
auctioneer. Personal on-site inspection of all lots, tracts, and personal property is
recommended. Failure of any bidder to inspect, or to be fully informed as to the condition
of the property will not constitute grounds for any claim or demand for adjustment or
withdrawal of bid, offer, or deposit money after its opening tender. Any and all
announcements made from the auction platform take precedence over all other verbal,
printed, announced and/or distributed information.
Auctions United, Inc. Is the agent of the Seller and their fiduciary duties of loyalty and
faithfulness are owed to their client, the Seller.
